Processing of your information

In connection with your psychological treatment, we are, as the data controller, obligated to collect and process a range of personal data about you, pursuant to the Danish Psychologists Act and the Executive Order on Orderly Records for Psychologists.

This privacy policy describes how we use and, in some cases, disclose your personal data in this context.

Types of information

Psykologhuset Enigma ApS collects and processes the following types of personal data about you (to the extent relevant to you):

General categories of personal data:

  • Name, address, email address (if applicable), phone number, social security number (CPR), gender, family and social relations, work relations, and education.

Special categories of personal data (“sensitive personal data”):

  • Health information

Purpose

We process your personal data for the following purposes:

  • Our treatment of you
  • Preparation of certificates for use by authorities, insurance companies, etc.
  • Communication with other healthcare professionals, doctors, or hospitals
  • Reporting to clinical quality databases
  • Billing purposes
  • Compliance with our obligations under applicable legislation, including the EU General Data Protection Regulation (GDPR), the Danish Data Protection Act, and other relevant health legislation, e.g.
    • Duty of documentation
    • Compliance with basic principles for processing personal data and legal basis for the processing
    • Implementation and maintenance of technical and organizational security measures, including but not limited to preventing unauthorized access to systems and information, preventing the receipt or distribution of malicious code, stopping denial-of-service attacks, and preventing damage to computer systems and electronic communication systems
    • Investigation of suspected or known security breaches and reporting to individuals and authorities
    • Handling of inquiries and complaints from data subjects and others
    • Handling of inspections and inquiries from supervisory authorities
    • Handling of disputes with data subjects and third parties.
    • Statistical studies and scientific research

Voluntary nature

When we collect personal data directly from you, you provide the personal data voluntarily. You are not obligated to provide this personal data to us. The consequence of not providing me with the personal data will be that we cannot fulfill the purposes above, including that we will not be able to treat you.

Disclosure of personal data

To the extent necessary for your specific treatment, your personal data will be disclosed to and shared with the following recipients:

  • Information is disclosed to other healthcare professionals if necessary for a current course of treatment.
  • Information is disclosed to the RKKP (clinical quality databases), the Danish Patient Safety Authority, the Psychologists Board, and Labor Market Insurance, to the extent that there is an obligation to do so under applicable legislation.
  • As a patient, you have access to your own information (right of access).
  • When reporting information in connection with billing for patient treatment, information is disclosed to regional billing offices.
  • When reporting to clinical quality databases.
  • In other cases, and provided that consent is given, information is disclosed to insurance companies.

The legal basis for collecting, processing, and disclosing your personal data is:

  • For the purpose of general patient treatment, general personal data is collected, processed, and disclosed pursuant to Article 6(1)(c) and (d) of the GDPR, while sensitive personal data is collected, processed, and disclosed pursuant to Article 9(2)(c) and (h) of the GDPR.
  • Furthermore, we are obligated to process a range of personal data about you during general patient treatment pursuant to the Danish Psychologists Act and the Executive Order on the Duty of Psychologists to Keep Orderly Records.
  • Your personal data is only disclosed to insurance companies with your prior consent, cf. Article 6(1)(a) and 9(2)(a) of the GDPR.

Withdrawal of consent. If the processing of your personal data is based on consent, you have the right to withdraw that consent. If you withdraw your consent, it does not affect the processing prior to the withdrawal, including any disclosure based on consent.

Use of data processors

Your personal data is processed and stored by our data processors, who store it on behalf of and according to instructions from us. Our data processors are currently:

  • Easypractice
  • Dinero

Storage and deletion policy

We store personal data about you for as long as we need to fulfill the purposes stated above. However, according to Section 15 of the Executive Order on Record-Keeping, we are obligated to store these for a minimum of 5 years after the last entry in the record. Cases may arise where we are forced to store your personal data for a longer period, e.g., in connection with a complaint or compensation case, in which case information will be stored until the case is finally closed.

Your rights

You have – within the limitations of the law – certain rights, including the right of access to personal data, the right to have incorrect information changed, the right to have information deleted, the right to have information restricted, the right to data portability, and the right to object to the processing of personal data, including in relation to automated, individual decision-making (“profiling”).

Regarding deletion, this right is modified by the Executive Order on the Duty of Psychologists to Keep Orderly Records, which stipulates that deletions may not be made in patient records, only corrections and additions.

You also have the right to lodge a complaint with a competent supervisory authority, including the Danish Data Protection Agency (Datatilsynet).

How do you remove or avoid cookies?

To delete cookies, go to Tools -> Internet Options -> General tab -> Press the Delete button -> Cookies -> Delete.

To block cookies, go to Tools -> Internet Options -> Privacy -> Move the slider to the top. This will block all cookies. -> Click OK.

Google Chrome
To delete cookies, press the tools button -> Tools -> Clear browsing data -> Delete cookies and other site data -> Clear browsing data.

To block cookies, press the tools button -> Settings -> Show advanced settings -> Content settings -> Click on “Always block websites from storing data” and check “Block third-party cookies and site data” -> Ok

Safari
To delete cookies, press the tools button -> Settings -> Security -> Press the “Show cookies” button. Here you can either delete cookies from a single domain or remove all cookies.

To block cookies, press the tools button -> Settings -> Security -> Under “Accept cookies” select “never”.
